A Lei de Crimes Hediondos no Brasil prev\u00ea que estupro e estupro de vulner\u00e1vel s\u00e3o considerados crimes hediondos desde 2009, implicando penas mais severas.<\/p>\n\n\n\n<p>Na decis\u00e3o desta segunda-feira, o juiz Luiz Guilherme Cursino de Moura Santos, da Vara de Execu\u00e7\u00f5es Criminais de S\u00e3o Jos\u00e9 dos Campos, afirmou que o estupro, por si s\u00f3, j\u00e1 \u00e9 classificado como crime hediondo. Ele ressaltou que n\u00e3o \u00e9 necess\u00e1rio que o crime seja praticado por duas ou mais pessoas para ser considerado hediondo.<\/p>\n\n\n\n<p>O magistrado tamb\u00e9m mencionou que, em 2013, quando o crime pelo qual Robinho foi condenado ocorreu, o estupro j\u00e1 estava inclu\u00eddo na lista de crimes hediondos. A decis\u00e3o judicial foi tomada pouco mais de dois meses ap\u00f3s a defesa do ex-jogador ingressar com o pedido, na primeira quinzena de maio deste ano.<\/p>\n\n\n\n<p>A defesa de Robinho argumentou que o Superior Tribunal de Justi\u00e7a (STJ) homologou a senten\u00e7a italiana, mas que, no c\u00e1lculo da pena, o crime foi classificado como &#8220;hediondo&#8221;. O advogado sustentou que a homologa\u00e7\u00e3o da senten\u00e7a italiana n\u00e3o deveria automaticamente conferir a hediondez do crime no Brasil.<\/p>\n\n\n\n<p>\u00c0 \u00e9poca do crime, Robinho era um dos principais jogadores do Milan, na It\u00e1lia. A condena\u00e7\u00e3o ocorreu no in\u00edcio de 2022, em \u00faltima inst\u00e2ncia na It\u00e1lia. Robinho foi condenado pelo crime de estupro coletivo, cometido contra uma mulher em uma boate em Mil\u00e3o.<\/p>\n\n\n\n<p>O advogado do ex-jogador, contratado para defend\u00ea-lo no processo de execu\u00e7\u00e3o penal, afirmou que, segundo a defesa, o caso de Robinho deveria se enquadrar no artigo 217-A do C\u00f3digo Penal. Ele argumentou que o crime previsto nesse artigo deixou de ser hediondo em 2019, com o pacote anticrime.
