Por 9 votos a 2, os ministros rejeitaram dois pedidos de liberdade apresentados pela defesa. Edson Fachin, Cristiano Zanin, Lu\u00eds Roberto Barroso, Alexandre de Moraes, Andr\u00e9 Mendon\u00e7a, Fl\u00e1vio Dino, Nunes Marques e C\u00e1rmen L\u00facia votaram a favor da manuten\u00e7\u00e3o da pris\u00e3o. Os ministros Gilmar Mendes e Dias Toffoli divergiram, votando pela soltura de Robinho.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-contexto-do-caso\">Contexto do caso<\/h2>\n\n\n\n<p>Robinho foi condenado na It\u00e1lia a nove anos de pris\u00e3o pelo crime de estupro, ocorrido em 2013. Em mar\u00e7o deste ano, o Superior Tribunal de Justi\u00e7a (STJ) determinou que a pena fosse cumprida no Brasil, com base na Lei de Migra\u00e7\u00e3o, de 2017. A decis\u00e3o gerou questionamentos da defesa, que alegou inconstitucionalidade na aplica\u00e7\u00e3o da norma a um crime cometido antes de sua vig\u00eancia.<\/p>\n\n\n\n<p>Os advogados tamb\u00e9m argumentaram que o STJ n\u00e3o poderia determinar a execu\u00e7\u00e3o imediata da pena, uma vez que os recursos ainda n\u00e3o haviam sido esgotados. Al\u00e9m disso, contestaram a compet\u00eancia do tribunal para fixar o regime de pris\u00e3o.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-voto-do-relator\">Voto do relator<\/h2>\n\n\n\n<p>Luiz Fux destacou que o STJ agiu conforme a legisla\u00e7\u00e3o vigente e n\u00e3o violou normas constitucionais, tratados internacionais ou regras de compet\u00eancia. Segundo o ministro, a pris\u00e3o de Robinho est\u00e1 amparada pela legalidade. \u201cN\u00e3o se vislumbra viola\u00e7\u00e3o [&#8230;] a caracterizar coa\u00e7\u00e3o ilegal ou viol\u00eancia contra a liberdade de locomo\u00e7\u00e3o do paciente\u201d, afirmou Fux.<\/p>\n\n\n\n<p>Edson Fachin seguiu o relator, mas o julgamento foi interrompido anteriormente por um pedido de vista de Gilmar Mendes. Com o retorno da an\u00e1lise, prevaleceu a decis\u00e3o de manter Robinho preso.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-proximos-passos\">Pr\u00f3ximos passos<\/h2>\n\n\n\n<p>Com a decis\u00e3o do STF, Robinho seguir\u00e1 cumprindo pena no Brasil.
